Building Permit F.A.Q.


  1. What authority allows LVPOA to control issuance of building permits?

    Each plotted lot within all Lake Victoria subdivisions has an abstract associated with it. Within the abstract is an entry placed and recorded with the Register of Deeds office located in Clinton County, Michigan. Item 3f of each Declaration of Restrictions states the following:

    3(F) The LVPOA Building Control Committee shall consider and recommend approval or disapproval of plans for all structures erected, placed or altered in this subdivision. The Committee may reject any plan because of too great a similiarity to nearby existing structures. The Building Control Committee shall take into account: harmony of exterior design of the proposed structure with existing structures on the lot and in the subdivision; location of the proposed building with respect to topography and finished ground elevation; whether applicant has obtained any necessary approval from county authorities; compliance with property restrictions; and existence/sufficiency of any necessary construction bond.



  2. What information MUST be submitted for a NEW building permit?

    a. Completed LVPOA New Building Permit Application  form. (Click link to display a printable, new construction, building permit.)

    b. All LVPOA lot numbers and their subdivsion(s) owned by land owner. Used to assure all assessments are paid. If assessments are NOT PAID up to date, NO PERMIT will be issued until treasurer has indicated such.

    c. Plot plan (example) submitted on a 8.5" x 11" plain white sheet of paper, legiable and clearly depicting the
        1. Lot(s) layout with lot dimensions
        2. Layout and location of house or structure on the plot plan (structure needs to include attachments such as
            garages, porches, decks) and its dimensions showing front, rear, side setback distances.
        3. Driveway location
        4. Location of well, and septic tanks and drain fields showing dimensions and setback dimensions

    d. All lot lines and corner survey markers must be located, identified and flag staked, at the lot owners expense. All of the building corners must be accurately staked prior to inspection by the building control committee.

    e. Complete set of construction drawings showing:
        a. dimensions of structure
        b. elevations showing, front, rear, both sides, lot topology if appropriate.
        c. floorplans
        d. type of construction materials.

    f. Description of any requested LVPOA variance or Clinton County zoning variance requested.


  3. g. Yellow copy of water permit from Mid-Michgan Health Department.

    h. Yellow copy of sewage permit from Mid-Michgan Health Department.

    i. If an engineered system has been approved, the design of the system can be submitted on 8.5" x 11" reduced copies


  4. What information must be submitted for an ALTERATION building permit application?

    a. The same as NEW construction listed in Item a-f above.

  5. Where do I submit the requested information and building permit?

    To prevent delays, you should deliver the requested materials to the Building Control Committee chairman. Any other building control member would be next choice. Any board member would be last choice. Click on Building Control Committee for contact information



  6. What role does Clinton County Building Department have in the LVPOA permit process?

    "Clinton County Building Department" has neither the authority or responsibility to enforce the LVPOA Property Deed Restrictions. It is the responsibility of the owner/builder to submit the completed LVPOA Building Permit and other information listed in Item 4. below PRIOR TO THE START OF SOIL MOVEMENT.

  8. How often should I read this page?

    If you are a builder, it is recommended that you review this page whenever you expect to fill out an application, as this information is subject to change.



  9. Is there a building permit fee?

    There are no fees associated with the permit process.



  10. How long will approval take?

    If you have turned in the requested information directly to the Building Control Committee Chairman, you should receive approval or disapproval notification within 3-7 days depending on weather, vacations, etc., if no variances are being requested. If variances are being requested, board approval may be necessary and depending on when the requested information has been filed relative to the board meeting(s) (which are held normally the third Tuesday of the month), a delay of up to 30-60 days can be expected.



  11. How is a variance requested?

         a. You must request and submit written approval of all adjoining property owners for property setback variances. For other variance types, written approval of all property owners within 500'.
         b. Complete description of the variance desired on the LVPOA Building Permit application. (attach additional pages as necessary).

    NOTE: ADJOINING PROPERTY OWNER APPROVAL DOES NOT GUARANTEE VARIANCE APPROVAL!!!



  12. Who reviews and who approves this application?

    The Building Control Committee should normally consist of three members. The Building Control Committee chairman oversees the committee. The chairman seeks to have a minimum of two signatures on the permit. If the committee is not in agreement on any submitted permit, then the chairman shall submit the permit to the LVPOA Board of Directors at their next regulary scheduled board meeting held on the third Tuesday of each month excluding July and December, who will then make a determination of approval or denial.

BUILDING PERMIT APPLICATION INSTRUCTIONS



This application may be prepared by the lot owner or contractor.
This application must be signed by the lot owner(s).


IMPORTANT NOTICE TO ALL APPLICANTS FOR A BUILDING PERMIT

In order to assure the most rapid processing of your application, we ask your cooperation in the following matters:

  1. In order to be processed, your application must be complete. Our committee members have been instructed not to accept incomplete applications. If you are unable to provide requested information, please contact one of them.


  2. You must supply an reasonably accurate plot plan reasonably drawn to scale! (See sample map, last page.)

  3. Lot Flagging

    You must flag the front, rear, and side lines of your lot as follows:

    1. A distinct flag must be placed at each corner of the lot.


    2. Flags must be placed on the side lines adjacent to the proposed structure such that appropriate setback distances from the structure can be determined. If you do not flag the lot such that your lot configuration cannot be determined, your application WILL NOT be approved until such time as location can be determined.


    3. YOU ARE RESPONSIBLE FOR PROVIDING SUFFICIENT INFORMATION TO THE COMITTEE TO ALLOW PROPER REVIEW OF YOUR APPLICATION. IF YOU ARE UNABLE OR UNWILLING TO SUPPLY ADEQUATE INFORMATION YOUR APPLICATION WILL, OF NECESSITY, BE DENIED.


    4. All information required in the attached application form must be TYPED OR NEATLY PRINTED in black or blue ink.


    5. Acceptance of your application by the Building Control Committee does not guarantee your application will be approved by the Building Control Committee or the LVPOA Board of Directors.
